This website belongs to Asiarooms Pte Ltd (hereinafter referred to as "AsiaRooms"), a legally constituted Singapore company. AsiaRooms registered office is 73 Bukit Timah Road #03-01 Rex House, Singapore 229832. The content of this website is directed solely at consumers who book the product through AsiaRooms (hereinafter referred as "you" or "your").The following Terms and Conditions form the basis of your relationship with AsiaRooms. Please read them carefully as they set out our respective rights and obligations. Access to the AsiaRooms website is strictly controlled by AsiaRooms and AsiaRooms reserves the right to change, modify, substitute or suspend or remove without notice any information or service from time to time. References to "accommodation providers" means the owner/providers of the hotels, apartments, villas and other accommodation of any description featured on this website and "accommodation" means the accommodation including all facilities and services advertised on our website that we have agreed to arrange in connection with your confirmed booking. AsiaRooms acts as agent only in respect of all bookings we make on your behalf. AsiaRooms accepts no liability in relation to any contract you enter into or for any accommodation that you book or for the acts or omissions of any accommodation or other person(s) or party(ies) connected with your booking. For all bookings your contract will be with the accommodation provider concerned. The accommodation provider’s booking conditions will apply to your contract and prices and cancellation conditions shall be displayed when making each reservation, dependant on prevailing conditions, availability and other factors. The website will guide you through the booking procedure. Any booking that you make through this website is conditional on you accepting these General Terms and Conditions, the legal statement and Privacy Policy (the "Terms"). The Terms form an integral part of our website and cannot be separated from the general contracting conditions, operations or reservations. By visiting, using or ordering from the website AsiaRooms, you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this website and your booking. If you do not agree to be bound by the Terms, you must not proceed with your booking. Modification of Terms and Conditions AsiaRooms may make improvements or changes to the information, elements, data, services, and other materials on this website, or terminate this website, at any time without notice. AsiaRooms may also modify the Terms at any time, and such modification shall be effective immediately upon posting of the modified Terms on this website. Accordingly, your continued use of or access to this website will be deemed to indicate your acceptance of the modified Terms. AsiaRooms may suspend access to website, due to maintenance works, net security reasons or force majeure, with no obligation to reimburse or compensate you for the period in which access was suspended. 2. Non accommodation services The AsiaRooms websites advertises the sale of Flights and Travel Insurance. AsiaRooms does not collect payment for Flights or Travel Insurance and no contracts exist between you and AsiaRooms for these services. Contracts for Flights and contracts for Travel Insurance are between you and the Flights provider and Insurance Underwriter respectively. Terms and Conditions for Flights and Travel Insurance services are set out by the providers of these services within the AsiaRooms website. 3. How to book your accommodation Simply search for your chosen destination and dates, select your preferred accommodation provider and proceed to the final reservation page making sure that you have given us your email address and valid credit card number. Please ensure you carefully check the dates, the price, the destination and the accommodation provider details before proceeding with your booking request. Any information entered into our payment page is securely encrypted during transit and the AsiaRooms site is verified by Thawte. For more details on this area, please refer to "Payment Details" below. To make a booking, you must be authorised to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due to us. Due to our high volume of reservations, our consultants are unable to do individual availability checks for clients (apart from Instant Availability bookings which our system checks automatically). We only perform accommodation reservations. To make a booking, you must submit a reservation form and provide your credit card details. A block / authorisation will be made on your credit card for the full value of the booking request but no charge will be made to your credit card at this time (unless this is an Instant Availability booking). Then we will check availability with the hotel and revert to you. It is our policy to reply to all requests within 24 to 48 hours (this time may be longer during high season, weekends, festival periods or special events). If we cannot fulfil your booking request, you will be notified via an e-mail (within 24 to 48 hours after placing your order) and you will not be charged. We will do our best to suggest to you an alternative hotel. Even if we accept all bookings that are made on the check-in date, we can only guarantee bookings made at least 2-working days (not including Sundays & Public holidays) before the check-in date (if the hotel has not already been fully booked). The earlier you book, the better chance you have to get a confirmed reservation. If or when we confirm your booking you will receive an email confirmation that will contain a link to a voucher for your hotel stay which should be retained and printed so it can be presented to the accommodation provider on arrival. Please check the accommodation booking voucher carefully as soon as you receive it and contact the AsiaRooms customer services immediately if any information which appears on the accommodation booking voucher or any other document appears to be incorrect or incomplete. As AsiaRooms acts only as an agent we will have no responsibility for any errors in any documentation except where those errors were made by AsiaRooms in which case AsiaRooms will correct the documentation and inform the accommodation provider appropriately. If special requests are accepted by the accommodation provider, a section will appear on the Reservation Form to insert such requests and submit them to the hotel. The hotel staff will do their best to accommodate special requests. We cannot guarantee that your requests will be granted because they will depend on the hotel availability. A binding contract between you and the accommodation provider comes into existence when we issue the confirmation e-mail containing the accommodation booking voucher on behalf of the accommodation provider. If you have been requested to return a Credit Card Data Authorisation form and copy of the cardholder's passport & credit card showing the signatures (together "Autorisation"), the binding contract will not exist until AsiaRooms receives the Authorisation. Reservation / booking number and the hotel voucher provided by AsiaRooms are for your sole and personal use; no reservation number or hotel voucher may be transferred or disclosed to third parties and you shall be directly responsible for the use of your own reservation number and hotel voucher. Improper use by you of any reservation number or hotel voucher shall result in the reservation number and voucher being withdrawn, any transaction will immediately be terminated and legal action against you may be considered. 4. Age and responsibility You warrant that you are 18 years of age or over and have legal capacity to use the AsiaRooms site and to create a legally binding contract. You warrant that all personal information submitted during accommodation bookings and membership registration is correct and you accept financial responsibility for all transactions made under your name or account. You hereby authorise AsiaRooms to ask for and to collect from the accommodation provider all personal information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group that the accommodation provider may have access to. The personal information that AsiaRooms collects from you and / or the accommodation provider shall be obtained, processed and transmitted in compliance with European Directives 95/46 and 2002/58, as well as any other such legislation that substitutes, complements and develops it. What's not included in your booking The basic accommodation cost does not include: Children Child prices and other conditions relating to children are agreed upon with each accommodation provider and are not based on any one criteria; therefore, given that each accommodation provider applies its own special conditions and prices, we ask that you enquire about this point when making your booking. Extra Beds Some accommodation providers have twin or double bedded rooms that will accommodate a third bed. Details on any supplement and/or discount applicable where a third bed is to be occupied by an adult can be obtained from the accommodation provider. Accommodation providers may have no, or limited numbers of, extra beds so the ability to provide a third bed will subject to availability. Any request for an extra bed must be made at the time of booking and if the accommodation is unable to meet any such request, neither AsiaRooms, nor the accommodation provider, will have any liability to you in this respect Failure to honour the booking (No Show) If, for whatsoever reason, you do not turn up at the accommodation on the arrival date stated on your accommodation booking voucher without prior warning to AsiaRooms ("a no show") this shall be considered a cancellation. In the event of a no show without prior warning you may not be entitled to any refund. Any refund is dependent on the accommodation providers’ cancellation / no show policy. This policy is set out in the confirmation email that you receive from AsiaRooms. 7. Payment Details At the time of your booking request, the full quoted amount will be blocked / authorised on your credit card. Only when the booking is confirmed will the credit card be charged (for Instant Availability bookings this is at the time of the booking request). Payment transactions on the AsiaRooms website are encrypted by a secure payment system endorsed by some of the world's leading banks and our site is verified by Thawte. This technically secure environment ensures that credit card details cannot be intercepted and are not revealed to anyone other than to financial institutions required to process payment instructions from the customer. Our payment system currently accepts the following payment methods: There is no charge, no fee to use our booking service for hotel reservations. In some instances AsiaRooms shall send by email the Credit Card Data Authorisation form; you must return the completed Credit Card Data Authorisation form to AsiaRooms by fax along with a copy of the cardholder's passport and credit card showing the signatures in order to confirm and conclude the booking process. Where this has been requested, the booking shall not be considered confirmed until AsiaRooms has received the Authorisation. Booking cancellation OR MODIFICATION You may cancel or modify your booking at any time prior to your arrival date. To cancel or amend a booking before arrival at the hotel please contact AsiaRooms by email, fax or telephone. To modify bookings after arrival at the hotel please contact either AsiaRooms or the hotel directly. A cancellation may result in refunds to you which will be made in the form of a credit to your credit card account. All credit card refunds will be processed in a timely manner (typically this takes 4 to 5 working days for the instruction to leave our bank). The refunds process is dependent on your billing cycle with your credit card company. Once the refund instructions leave our bank it can take up to one month for the proceeds to arrive in your account. Cancellations If you cancel the reservation prior to your arrival date, you may be charged a cancellation charge. AsiaRooms will refund you the amount paid under the contract minus any cancellation charges incurred by the accommodation provider. Typically, but not always : Any cancellation policies dictated by the hotel will always supersede the typical cancellation policy stated above and those hotel policies will be set out in the confirmation email that you receive from AsiaRooms. In such case our Customer Service Agents will of course inform you clearly and completely. Otherwise it will follow the typical cancellation policy stated above. Please note that the cancellation charge and/or period quoted refer to the time and date in the booked destination. Cancellation shall only come into force when confirmation of your cancellation is received by AsiaRooms, as opposed to when you send the cancellation notification to AsiaRooms. You shall be responsible for obtaining the confirmation and/or acknowledgement of receipt of the cancellation of the reservation by AsiaRooms. Reservations made via AsiaRooms may be cancelled by either party with no penalty whatsoever in the event of force majeure, such as, without restriction, war, revolution, acts of terrorism, closure of borders, epidemics, catastrophes which may affect the various destinations and, specifically, the location of the accommodation provider. In the event that AsiaRooms, at its own discretion, considers that a booking has been made fraudulently, the booking shall be cancelled and the transaction value will be returned to the same Credit card used for the transaction or AsiaRooms will wait until the credit card issuing a bank deduct the money from AsiaRooms in the form of a Chargeback. Modifications Modifications involving a partial cancellation, amendment or reduction in number of nights within the timescale that cancellation fees apply, may also be subject to cancellation expenses in line with the hotel cancellation policy. Any shortened stays on the hotel will be subject to 10% of the amount refunded to you (plus any additional cancellation charges in line with the hotel cancellation policy). Modifications to extend the reserved period shall be subject to availability and any increase in price will be charged and become payable immediately. Important
Changes to and cancellation of your booking by the accommodation provider If there is a change to or cancellation of your booking, AsiaRooms will pass on the new details to you together with any compensation that the accommodation provider may offer. As agent only for the accommodation provider, AsiaRooms cannot accept any liability for any changes or cancellations made to your booking. Proceeding with your reservation means you expressly accept such charges. Before you travel AsiaRooms is not liable for damages or losses that may result from travel to any particular destination. The USA Consular Affairs Bureau helps travellers stay safe overseas. Check their website at http://travel.state.gov/travel for latest advice on conditions in and general information concerning specific countries. It is your responsibility to ensure you have the relevant visa for the country you are visiting, plus any inoculations, ID’s, passport, etc. that may be required, and AsiaRooms shall not be liable for any circumstance or expense incurred due to lack of documentation or non-compliance with requirements. AsiaRooms also advises you to take adequate travel insurance prior to your travels. Insurance You are strongly advised to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to your home country / departure country in the event of an accident or illness. 11. Force majeure AsiaRooms will not be liable for any changes, cancellation, and effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or AsiaRooms to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and in particular the place where the accommodation provider is located as well as the country of origin of AsiaRooms and other unforeseeable causes beyond AsiaRooms’ control. 12. Complaints or issues with your accommodation In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action. Should you not be satisfied with the solutions offered, please contact AsiaRooms Customer Services, whilst you are at the accommodation, and we will offer all reasonable assistance to try and rectify the situation to your satisfaction. 24h/7days +66 38 364 700. AsiaRooms acts only as an agent for the accommodation provider and therefore cannot accept any liability for any loss or damages caused by the acts, omissions or negligence of any accommodation provider. Your contract for the accommodation is directly with the accommodation provider concerned. However, in the event that AsiaRooms is found liable on any basis whatsoever in relation to your booking our maximum liability to you if AsiaRooms is found to have been at fault in relation to any service that AsiaRooms provides as agent for the accommodation provider concerned (as opposed to any service provided by the accommodation provider for whom AsiaRooms is not responsible) is limited to the cost of the booking in question. AsiaRooms does not exclude or limit liability for death or personal injury that arises as a result of the negligent act or omission of AsiaRooms or its employees whilst acting in the course of their employment. 13. Indemnification AsiaRooms acts as an independent intermediary in the contracting of accommodation and other services, and shall thus not be held liable for death, injury, illness, damage, loss, accident, theft, delays or any other irregularity which may arise, whether directly or indirectly, from the supply of services by the accommodation provider or other suppliers and which have been contracted via this system. Also, AsiaRooms shall not be liable for any indirect, special or consequential loss, including economic loss, which term shall include loss of profits, loss of use of profits, business, revenue, and goodwill or anticipated savings. AsiaRooms shall make every reasonable effort to make the accommodation provider deal with any complaint you may raise. AsiaRooms shall not be able to assist with any claims that were not raised during the period of stay at the accommodation. AsiaRooms shall not be able to negotiate any claim with the accommodation provider that is raised after the date of your departure from the accommodation in question. You will at all times save harmless and keep fully indemnified AsiaRooms from and against any actions, claims, proceedings, losses, costs, expenses and demands (including costs and expenses in defending such matter and its proper compromise) arising directly or indirectly out of or incidental to or in connection with any breach by you or by any of the people you booked on behalf of, of any of the provisions of these Terms or contravention of any laws or rights of a third party, or your use of this website. When you book accommodation through AsiaRooms, you accept responsibility for the conduct of yourself and the other people on your booking during your stay. AsiaRooms and/or the accommodation provider reserves the right at any time to terminate your stay and that of any member of your party due to your or their misconduct, where justified in the reasonable opinion of AsiaRooms and/or the accommodation provider. Full cancellation charges will apply and no refund will be given. Furthermore, neither the accommodation provider nor AsiaRooms shall be under any obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of your stay being terminated. If your actions or those of any member of your party cause damage to the accommodation in which you are staying, you must fully reimburse the accommodation provider for the cost of the damage before you end your stay. You also agree to indemnify AsiaRooms against any claim (including legal costs) made against AsiaRooms as a result. Notwithstanding the above, AsiaRooms’ entire liability, whether in contract, tort (including breach of statutory duty), or otherwise shall not exceed the sums paid by you to AsiaRooms for the specific services in question. 14. PRIVACY Please refer to our Privacy Statement for details on our Privacy and Security policies. 15. General These Terms and Conditions contain some exclusions and limitations of liability. If any part of the conditions proves to be invalid or unenforceable, the rest of the conditions will remain valid. The invalid or unenforceable condition will be deemed as supplanted by an enforceable and valid form conveying the same meaning. Any dispute will be governed by the law and jurisdiction of the Singapore courts. You agree that your use of this website does not imply that any partnership, joint venture, employment or agency relationship exists between you and AsiaRooms. 16. Assignment of Rights AsiaRooms reserves its rights to assign in total or in part the obligation or rights of these Terms to any subsidiary, affiliate or holding company or any subsidiary of its holding company. You are not allowed to assign any obligation or right of these Terms, or any other agreement which completes them to any third party, unless with the prior express written authorisation of AsiaRooms. 17. Legislation and Courts of Jurisdiction The application and interpretation of these Terms and Conditions shall be governed by current and applicable Singapore Legislation. In the event of any discrepancy which may arise from the interpretation or execution of these terms and conditions, the parties, with express waiver of any other court of jurisdiction which might apply, if any, shall abide by the Jurisdiction and Competence of the Courts of Singapore. |
